Copyright & Display


The copyright Designs and Patents Acts assign the copyright of the images to the photographer. Any images or copies of images whether stored digitally or otherwise are protected by the Copyright and Design Act 1988.

 

Once images have been purchased, the supplied images can be used on social media, websites or similar providing the photographer is appropriately mentioned and tagged in a reasonable manner and that the images are not edited in any way. The purchaser is free to publish the images for-profit and non-profit so long as the photographer is appropriately referenced.

 

The photographer is free to display any image covered by this agreement to generally promote the business in advertising including social media. If there are any particular images the purchaser would not like to be shared publicly then this should be highlighted to the photographer at the earliest convenience and the photographer will do their best to accommodate where possible.

Limitation of Liability


In the unlikely event that the Photographer is unable to perform to the guidelines of the contract due to an injury, illness or other cause beyond the photographers control, the photographer will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event.

 

The photographer takes the utmost care with respect to exposure, transportation and processing the photographs, however, in the unlikely event that the digital files have been lost, stolen, or destroyed for reasons beyond the control of the photographer, including but not limited to camera, hard drive, or equipment malfunction, it will result in the return of a reasonable percentage of payments received for the event.

Archival Release


Once the images have been released to the purchaser, the photographer is under no obligation to retain the files after 1 calendar month from the event date. If the purchaser wishes to utilise the online gallery beyond this time then they should make this known to the photographer at their earliest convenience.
